Holder of copyright software visual displays brought action against
licensee, alleging that visual displays and images in licensee's product
infringed holder's copyrighted works. Licensee moved for summary
judgment, and copyright holder moved for partial summary judgment. The
District Court, Schwarzer, J., held that: (1) license did not cover
enhancements to licensee's computer software program, and (2) licensee's
computer program was not covered by license.
Patent holder's motion granted in part and denied in part, and licensee's
motion granted in part and denied in part.
